The Project was under litigation in the Southern bench of National Green Tribunal (NGT) for the violation of environmental laws. Litigants have accused the builder of encroaching upon Rajakaluve and obstructing the flow of storm water into the two interconnected lakes – Kasavanahalli Lake and Kaikondrahalli Lake.
NGT dismissed the litigation on the grounds that the project has a valid environmental clearance from the state government. However, NGT cleared the project only when the builder modified the plan to reduce the footprint of construction. The builder modified the plan to construct 17 towers with 810 residential units as against 21 towers and 870 residential units in the original project plan.
Buyers need to be careful as any flooding in the locality can increase the scrutiny of government agencies and courts with regard to any violation or disturbance caused to environment because of the construction activity. Shubh Enclave had witnessed demolition exercise in 2016 from BBMP as there was serious flooding in the layout caused by blockage of storm water drains.
